Rogue State - 20100209

China is a genuine rogue state. We could see how "law", if it could still be labelled so, is to be utilized by the thug in the following example.

Writer 譚作人 (Tam) disclosed the sub-par quality of Sichun's infrastructure, after the earthquake occurred in 2008. Today, Tam was sentenced to a 5-year imprisonment, in the name of subversion.

Superficially, China is a state operates under the civil law, which law should has been codified in a "book". Thus, as everything has been written down, it should not be that difficult to see if anyone has offended the law. Back to Tam's case, it is a blatant example of selective prosecution, under the facade of a piece of subversive article.

Legally sound, by unfairly executed. There are tones of articles similar to Tam's, but almost everybody are still sitting at home, safely.

All Chineses know the real reason behind the charge is the Sichun's report. By following LXB's precedent, Tam's conviction is most predictable. Though unlike common law, the rule of precedent is not needed to be adhered by civil law. Paradoxically, when the case is leaning forward the Communist party, they would be happy to adopt it.

After all, in China, anything is a sheer apparatus for the Communist party to make ends meet. Tam's case is just another typical example of rule by law.
